German Parts USA reserves the right to correct typographical errors, inaccuracies, omissions, pricing errors, and product information at any time.

3. VEHICLE FITMENT AND COMPATIBILITY

Vehicle fitment information is provided as a convenience to customers and is based on the information reasonably available to German Parts USA.

The customer is responsible for verifying that a product is appropriate for the specific vehicle before installation.

Compatibility may depend on factors including, but not limited to:

• vehicle model;

• VIN or chassis number;

• production date;
• market specification;
• factory equipment;
• optional equipment;
• previous repairs;
• modifications; and
• superseded or previously replaced components.

A vehicle model designation alone does not necessarily guarantee compatibility.

Installation of a product constitutes acceptance of its apparent fitment unless the product contains a defect that could not reasonably have been discovered before installation.

4. PROFESSIONAL INSTALLATION

Automotive parts should be installed by a qualified automotive technician when the installation requires technical knowledge, special tools, adjustment procedures, safety procedures, or manufacturer-specific specifications.

The customer is responsible for ensuring proper installation, adjustment, maintenance, and use of all products.

German Parts USA is not responsible for damage resulting from incorrect installation, improper adjustment, misuse, installation on an incompatible vehicle, failure to follow manufacturer specifications, or installation performed without the necessary technical knowledge or equipment.

Safety-related components must be installed and inspected in accordance with applicable vehicle manufacturer procedures and generally accepted automotive repair practices.

5. OEM, AFTERMARKET, REPRODUCTION, AND OTHER PARTS

Products sold by German Parts USA may include genuine/OEM parts, aftermarket parts, reproduction parts, remanufactured parts, New Old Stock (“NOS”), or other specialty automotive components.

The applicable product description will identify the product category where relevant.

Reproduction or aftermarket products are not represented as genuine Mercedes-Benz products unless expressly identified as such.

NOS and older original components may show reasonable signs of long-term storage, aging of packaging, discoloration, cosmetic imperfections, or other age-related characteristics that do not necessarily affect functionality.

6. TRADEMARKS AND VEHICLE MANUFACTURER REFERENCES

Mercedes-Benz, Mercedes, the Three-Pointed Star, associated model names, part numbers, and other trademarks or identifiers referenced on this Website are the property of their respective owners.

Unless expressly stated otherwise, German Parts USA LLC is an independent business and is not affiliated with, sponsored by, endorsed by, or authorized by Mercedes-Benz Group AG, Mercedes-Benz USA, LLC, or their affiliated companies.

Manufacturer names, vehicle models, and original part numbers may be used solely for identification, reference, and compatibility purposes.

7. PRICING

All prices are listed in U.S. Dollars (USD) unless otherwise stated.

Prices may change without notice.

Applicable sales tax, shipping charges, customs charges, duties, or other fees may be added where required and will be displayed or calculated as applicable during checkout.

In the event of an obvious pricing or listing error, German Parts USA reserves the right to cancel the affected order and issue a refund of amounts paid.

8. ORDERS

Submission of an order does not necessarily constitute final acceptance by German Parts USA.

11. INTERNATIONAL ORDERS

German Parts USA may ship products outside the United States where available.

• VAT;
• brokerage charges;

German Parts USA is not responsible for delays caused by customs authorities.

12. RETURNS

Unless otherwise stated on the applicable product page, eligible unused products may be returned within 30 days of delivery.

To qualify for a return, the product must:

• be unused and uninstalled;
• be in resalable condition;
• include all components supplied with the product; and
• be returned in the original packaging where reasonably applicable.

Customers should contact German Parts USA before returning a product to obtain return instructions.

Unless the return results from an error by German Parts USA or a defective product for which German Parts USA is responsible, the customer is responsible for return shipping costs.

Original shipping charges are generally non-refundable except where required by law or where the return results from our error.

13. NON-RETURNABLE ITEMS

Customers should retain the product, packaging, labels, and relevant documentation until the issue has been resolved.

Installing an obviously incorrect or visibly damaged component may affect eligibility for reimbursement of costs resulting from continued installation or use, to the extent permitted by law.

15. DAMAGED OR INCORRECT SHIPMENTS

Customers should notify German Parts USA promptly after discovering that an item was damaged during shipment or that an incorrect product was delivered.

We may request photographs of the product, packaging, shipping label, damage, or other information reasonably necessary to process the claim.

Do not discard damaged products or packaging until the claim has been resolved.

16. WARRANTIES

Products may be covered by a manufacturer warranty, a warranty specifically provided by German Parts USA, or another warranty expressly stated on the applicable product page.

The existence, duration, and scope of any warranty will be determined by the written warranty applicable to the specific product.

Except for warranties expressly provided in writing and except to the extent prohibited by applicable law, German Parts USA makes no additional warranties regarding products sold through the Website.

18. LABOR AND RELATED COSTS

Unless expressly agreed in writing by German Parts USA or required by applicable law, the purchase price of a product does not include reimbursement for labor, diagnostic charges, towing, vehicle storage, rental vehicles, loss of vehicle use, removal or installation costs, or other expenses associated with replacing or diagnosing a product.

Customers should verify the product and its compatibility before incurring installation expenses.

19. PERFORMANCE AND MODIFIED VEHICLES

Some products may be intended for modified, restored, classic, collector, performance, or competition vehicles.

Modifications to a vehicle may affect compatibility, reliability, emissions compliance, road legality, insurance coverage, or manufacturer warranties.

The customer is responsible for determining whether installation and use of a product complies with applicable federal, state, and local laws and regulations.

Products are not represented as emissions-compliant or legal for road use unless expressly stated.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GERMAN PARTS USA LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM THE PURCHASE, INSTALLATION, USE, MISUSE, OR INABILITY TO USE A PRODUCT.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF USE, LOSS OF PROFITS, LOSS OF BUSINESS, VEHICLE DOWNTIME, TOWING EXPENSES, RENTAL VEHICLE COSTS, OR OTHER CONSEQUENTIAL LOSSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF GERMAN PARTS USA ARISING FROM A PRODUCT TRANSACTION SHALL NOT EXCEED THE AMOUNT PAID TO GERMAN PARTS USA FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

21. WEBSITE USE

The Website and its content may be used only for lawful purposes.

Users may not attempt to:

• interfere with the operation or security of the Website;
• gain unauthorized access to systems or customer information;

This provision does not eliminate any refund, cancellation, or other consumer rights that cannot lawfully be waived.

24. FRAUD AND CHARGEBACKS

German Parts USA reserves the right to contest fraudulent or improper payment disputes and to provide transaction records, shipping information, communications, proof of delivery, and other relevant documentation to payment processors, banks, or card issuers as permitted by law.

Nothing in this section limits a customer's lawful rights to dispute a transaction.
